End User Licence Agreement

This End User Licence Agreement governs the installation and use of the Qwint Caption Software.

By downloading, installing, copying, activating, or using the Software, you agree to this Agreement.

01 Ownership

The Software is licensed, not sold.

Qwintsoft LLP and its licensors retain ownership of:

  • Software code.
  • Executable files.
  • Installation scripts.
  • Interfaces.
  • Documentation.
  • Updates.
  • Template source files.
  • Associated intellectual property.

02 Licence Grant

Subject to payment and compliance with this Agreement, Qwintsoft LLP grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to install and use the Software according to your plan.

Unless otherwise stated, the licence permits:

  • Use by one named individual.
  • Installation on up to two devices owned or controlled by that individual.
  • Personal and professional video-editing work.
  • Commercial use in completed video Outputs.
  • Use with media you own or are authorised to process.

03 One-Time Licence

For an eligible one-time plan, the licence to the version delivered at purchase continues unless terminated under this Agreement.

Updates are included only for the period stated at purchase.

A continuing licence does not guarantee:

  • Future compatibility.
  • Permanent cloud services.
  • New features.
  • Future template packs.
  • Support forever.

04 Subscription Licence

A subscription licence exists only during an active paid subscription.

After expiry or cancellation, you must stop using the Software and Template source files obtained under the subscription.

Possession of downloaded files does not create an ongoing licence.

05 Template Licence

Included Templates are governed by the Intellectual Property and Template Licence.

You may use Templates to create completed and rendered videos.

You may not distribute Template source files separately or as part of a reusable project, pack, product, or competing service.

06 Restrictions

You may not:

  • Share a licence or activation credential.
  • Permit multiple users to use a single-user licence.
  • Sell, rent, lease, sublicense, or transfer the Software.
  • Redistribute the ZIP package.
  • Publish or upload Software or Template files.
  • Reverse engineer, decompile, or disassemble protected components, except where applicable law expressly permits it.
  • Bypass activation or usage controls.
  • Remove copyright or proprietary notices.
  • Modify the Software to avoid payment or limits.
  • Use the Software to create a competing caption-template library, plugin, or service.
  • Use automated systems to extract or reproduce the Templates.
  • Misrepresent ownership of Qwint Caption technology.

07 Backup Copy

You may retain one reasonable backup copy for your own licensed use.

A backup copy remains subject to this Agreement and may not be shared.

08 Activation and Device Information

The Software may communicate with our servers to:

  • Verify a licence.
  • Register or remove device activations.
  • Check credit balances.
  • Prevent fraud.
  • Deliver updates.
  • Enforce plan restrictions.

We may process hashed or pseudonymous device identifiers as described in the Privacy Policy.

09 Updates

Updates may add, remove, alter, or fix functionality.

Security or compatibility updates may be required for continued access to online features.

An update does not expand your licence beyond your purchased plan unless expressly stated.

10 Adobe Compatibility

Qwint Caption is an independent extension intended for supported Adobe software.

Adobe may change its applications, extension framework, security requirements, or technical specifications.

We do not control Adobe and cannot guarantee compatibility with every past or future version.

11 Third-Party and Open-Source Components

The Software may include third-party or open-source components governed by their respective licences.

Where required, applicable notices will be provided in the Software, documentation, or distribution package.

12 Feedback

You may voluntarily provide suggestions or feedback.

You grant us permission to use non-confidential feedback to improve our products without payment or restriction.

This does not transfer ownership of your media or private content.

13 Licence Termination

This licence terminates when:

  • A subscription expires.
  • A refund is issued.
  • Payment is reversed.
  • You materially breach this Agreement.
  • The licence was obtained through fraud or an unauthorised source.

Upon termination, you must:

  • Stop using the Software.
  • Uninstall it.
  • Delete the ZIP package.
  • Delete Template source files.
  • Delete backup copies.
  • Stop sharing or distributing any licensed component.
  • Confirm deletion when reasonably requested.

14 Completed Videos

Unless termination resulted from infringement, fraud, or unlawful use, completed and rendered videos created while the licence was valid may continue to be displayed and distributed.

Termination does not permit creation of new videos using the Software or Template source files.

15 Verification

We may use payment, download, activation, device, and usage records to verify licence compliance.

We will not access unrelated files on your device for licence verification.

16 Warranty and Liability

The warranty disclaimers and liability limitations in the Terms of Service apply to this Agreement.

Nothing in this Agreement limits a non-excludable statutory right.

17 Governing Law

This Agreement is governed by Indian law.

Subject to applicable consumer rights, courts with jurisdiction over Rajkot, Gujarat will have jurisdiction.
